TERMS AND CONDITIONS FOR DONATIONS – M3 2025

1. PREAMBLE

The Association Objectif Environnement ("OE") is a non-profit organization under Swiss law that supports projects combining sports and nature conservation. OE is organizing the "Odyssée Méditerranée II" campaign and the sporting challenge of Noam Yaron, which it has partnered with to use the world record for the longest swim for Nature (see details on the RECORD page) to raise awareness among different target audiences about the preservation of the Mediterranean and the Ocean, as well as the protection of biodiversity.

In this context, OE is launching a donation campaign "M3," allowing anyone to financially contribute to this awareness campaign "Sports for Nature."

2. PURPOSE

These general terms and conditions ("T&C") define the participation terms for the donation campaign organized by OE through the symbolic preservation of M3 on Noam Yaron’s sports challenge website: www.calvi-monaco.com. The URL of the site may vary depending on the country.

3. DONATIONS AND IRREVOCABILITY

Any donation made is a voluntary, free, and non-refundable act.

The funds raised are intended to finance the "Odyssée Méditerranée II" campaign, including the organization of the sporting challenge, social media and media communications, and any other actions related to the execution of the project and its campaign. (For more details, see: OUR CAMPAIGN) The funds raised may also be used to finance other sporting challenges with a similar mission, i.e., using sports to raise awareness about nature preservation.

By making a donation, donors acknowledge and accept that their contribution grants them no ownership, exploitation, or control rights over the event or the actions financed.

4. PAYMENT METHODS

Payments are made via the Stripe platform, which accepts various payment methods such as Visa, Mastercard, Apple Pay, Google Pay, SEPA, PayPal, etc.

The availability of certain payment methods may vary depending on the donor's country of residence and Stripe's specific conditions.

5. NO REFUNDS

All donations are final and non-refundable, regardless of the evolution of the campaign or associated sporting challenges.

By making a donation, contributors expressly waive any request for a refund, compensation, or reimbursement.

6. TAX DEDUCTIBILITY

As of today, donations made under this campaign are not eligible for tax deductions according to applicable Swiss tax laws.

It is the responsibility of each donor to inquire with local tax authorities or a tax advisor regarding potential deduction methods in their country.

The only documents provided are the payment receipts automatically generated by Stripe. No other documents can be requested from OE or its partners.

OE and its partners disclaim any responsibility for any penalties or tax consequences resulting from the donor's incorrect reporting of the donation.

7. DATA PROTECTION

OE is committed to protecting the personal data of donors in accordance with the General Data Protection Regulation (GDPR) and the Swiss Data Protection Act (nLPD).

The collected information will only be used for:

Managing donations;
Communications related to the campaign, made by OE and its partners.

Donors can exercise their rights to access, correct, and delete their data by contacting OE via the "Unsubscribe" button found at the bottom of each newsletter sent. No manual deletion requests can be made to OE or its partners.

8. LIMITATION OF LIABILITY

OE cannot be held responsible for any technical malfunctions of the Calvi-Monaco website hosting the M3 donation campaign or third-party services used for collecting donations, such as Wix, Stripe, or any other payment or hosting system.

OE reserves the right to suspend or stop the donation campaign at any time, without notice or justification, and without entitling contributors to any right to a refund.

9. APPLICABLE LAW AND JURISDICTION

These terms and conditions are governed by Swiss law.

In the event of a dispute regarding the interpretation or execution of these terms, the parties agree to seek an amicable solution within a reasonable time before initiating any legal proceedings. If no agreement is reached, any dispute will be subject to the exclusive jurisdiction of the competent courts in the canton of Vaud, Switzerland.

10. AMENDMENTS TO THE TERMS AND CONDITIONS

OE reserves the right to amend these terms and conditions at any time.

New versions will be published on the M3 platform and will take effect immediately after being posted online.

Any substantial change affecting the rights or obligations of the donors will be notified on the platform or by email to donors who have made a donation within the last 30 days.

11. SEVERABILITY CLAUSE

If any provision of these terms and conditions is declared null, invalid, or unenforceable for any reason, such nullity, invalidity, or unenforceability will not affect the validity of the remaining provisions, which will remain fully applicable.

13. MONTHLY DONATIONS

For monthly donations, contributors can cancel their subscriptions at any time by sending an email to objectifenvironnement@gmail.com. Upon receipt of the cancellation request, OE will stop the monthly donation within 30 days. All donations made up until the cancellation date including the 30 days delay are due and non-refundable.
